
The Federal Communications Commission asked US top court to review the incident, which took place during 2004 Super Bowl when Janet Jackson instantly showed her right breast while performing together with Justin Timberlake.
The incident has already once appeared in the court, when CBS Broadcasting Inc., one of the largest US radio and television networks, was sued for broadcasting such an uncensored performance.
The TV giant received more than 500,000 complaints just after the performance was aired and the company apologized quickly to avoid further complications. Janet Jackson called this an accident, while Justin’s opinion was that this was an obvious ‘wardrobe malfunction’.
CBS was then taken to court despite of apologies it maid. The broadcast company was required to pay a $550,000 fine, but at that time US Circuit Court of Appeals ruled that CBS is not responsible for the incident.
However, according to BBC: “The FCC said the court incorrectly applied a rule - which has since changed - regarding expletives that required a profanity be repeated before it is deemed indecent. The FCC contends that the rule did not apply to images. At the time, broadcasters did not employ a video delay for live events, a practice that changed within a week of the game. “
Now FCC wants US Circuit Court of Appeals to review the decision and make CBS pay the fine.
However, whatever happens, this is just one more news making Janet Jackson’s name even more popular. The more scandals and rumors surround a star, the more popular the star becomes, even if the news are court related.
