On Monday April 16, 2007, a unanimous judgment of seven judges of the Supreme Court in Abuja ruled in favour of Alhaji Atiku Abubakar, to contest the presidential election in Nigeria, on April 21, 2007.
The court said the Independent National Electoral Commission (INEC), has no legal power to disqualify the presidential flag bearer of the Action Congress (AC) party, the main opposition party to the ruling Peoples Democratic Party (PDP). The historic judgment has not only vindicated the case of Vice President Atiku Abubakar, but also justified the cases of other political aspirants who were disqualified by INEC and prevented from contesting for elective posts at the last state assembly and governorship elections of Saturday April 14, 2007.
The Independent National Electoral Commission (INEC) disqualified many political aspirants from the opposition parties in the flawed elections of last Saturday and paved the way for the ruling party, PDP to claim victories in most of the 36 states in Nigeria. But, the Supreme Court judgment in favour of Alhaji Atiku Abubakar will overrule the illegal actions of INEC.
