Salim Hamdan, who was convicted of aiding al-Qaida in August and sentenced to 5 1/2 years in prison, is on his way home to Yemen. He would have been eligible for release in January with credit for time served.

Although Hamdan is not being freed, he is being transferred from the U.S. detention facility at Guantanamo Bay, Cuba, and will serve out the remainder of his time in Yemen, said an anonymous senior defense official, who spoke on condition of anonymity.

Hamdan was the the first detainee convicted after a war crimes trial in the post-9/11 timeframe, and was given a relatively light sentence, which both embarrassed and disappointed U.S. prosecutors.

However, many said that Hamdan was a nobody, and was not a terrorist threat to the U.S. Honestly, he was just a driver, after all.

It should be remembered that Adoph Hitler's driver, Erich Kempka, was not tried as a war criminal after WWII, though he was called to testify.
