Oprah Winfrey, Dr. Mehmet Oz Sue Over False Endorsements

Talk show host Oprah Winfrey and Dr. Mehmet Oz, the New York-Presbyterian Hospital Columbia doctor who is a regular guest on her show, Wednesday sued advertisers using their names without permission in Internet ads. The ads generally center around dietary supplements.

The lawsuit names more than 50 businesses. Winfrey's companies, Harpo Inc. and OW Licensing Co., and Oz's Zo Co. filed papers in New York on Wednesday to stop the "unauthorised and unlawful use" of their names, pictures, voices and trademarks which the pair says have "gravely injured" their reputations.

The "scam" products include dietary supplements, colon cleansers, anti-wrinkle creams and tooth-whiting products. According to the lawsuit, mMany of the offers turn out to be fraud, which end up charging consumers for free trials or monthly subscriptions to products agreeing to the charges.

The papers state: "These defendants are willfully capitalising on plaintiffs' valuable reputation and intellectual property rights to lure consumers into ordering their infringing products on the false premise that they have been tested or recommended by Ms. Winfrey and/or Dr. Oz when they have not."

While Dr. Oz has been a frequent guest on Oprah's show, he's getting one of his own. He will debut his own program, "The Dr. Oz Show," on FOX, September 14.
