Spectators described it as a "legal lynching" when The "Church" Cult of Scientology placed a man from a Boston suburb on trial for harassment. Gregg Housh, was on trial for months at a time when the Church of Scientology in part of the Suffolk County (Boston) District Attorney's Office charged him with two charges of criminal harassment and trespassing. Both charges have been dropped based on non-adequate prosecutor evidence. The trials series went on since March - a period of 7 months. The question is why would a church spend months at time and 10 pre-trial hearings to get a result that would seem awkward to any legal minds.
The District Attorney office failed to achieve evidence that meet a burden of proof standard. After a review of the evidence, prosecutors determined they could not meet their burden of proof beyond a reasonable doubt on this charge [of criminal harassment] and could not in good faith move forward with it.
Had the case gone to trial, prosecutors would have introduced evidence and testimony to show that Housh and others entered the Church of Scientology's Beacon Street building in a boisterous manner during a March 1 protest, disturbing the proceedings and alarming those inside.
Critics of the cult say that the trumped-up charges were brought on because Mr. Housh was the purveyor of the permits for the first Boston Protest. This involves a process where an actual person must file a permit with the city government to reserve a protesting spot. This is a public filing, which is in public records, in which anybody can get a hold of. Scientology's lawyers used i to finally get a name of someone in Anonymous here in Boston. They then turned their full attention to him because he is the only person they had any information to go on.
The Scientology vs. Gregg case proved to many part of Scientology's Fair Game Act, which the church claims that it was dismissed 40 years ago, but its right here in the open. Fair Game is a scientology rule which is based in the teachings of postmortem cult leader, L. Ron Hubbard, in which he defined the "penalties" for an individual deemed to be in a "Condition of Enemy"
ENEMY - SP Order. Fair game. May be deprived of property or injured by any means by any Scientologist without any discipline of the Scientologist. May be tricked, sued or lied to or destroyed.
Anonymous, a human rights group, declared a war against the Cult of Scientology in which Scientology tried to pull a Tom Cruise Video from the internet. war persisted into its 10 month now in which Scientologist have stalked, assaulted, tried to sue, and even a case of attempted murder of Anonymous. In previous PR attempts, Scientology have stated that they want to stop Anonymous which have been dismal.
"The purpose of the suit is to harass and discourage rather than win. The law can be used very easily to harass, and enough harassment on somebody who is simply on the thin edge anyway, well knowing that he is not authorized, will generally be sufficient to cause professional decease. If possible, of course, ruin him utterly."—L. Ron Hubbard, The Scientologist, a Manual on the Dissemination of Material, 1955
Scientology is has a history of being overly litigious. This lawsuit was their form of harassment, where the person getting sued, Mr. Housh, had to spend lots of money to just defend himself against a trumped up charge in a court room for months. Housh has endured 10 pre-trial dates for charges including harassment and disturbing the peace, which have been dropped. Additional charges were added at the expense of the cult. Estimates of the cost of his defense is unknown at the time. Since Boston Scientology took too long on a case where there was huge doubt, restitution can be in order for Mr. Housh.
WBCN, a radio station in Boston, even made a 3 day series about Scientology during its most popular radio hours - the Toucher and Rich show. The radio show tapes prove in favor of Housh. Mr. Housh was unavailable for comment at the time.
