Psystar Hires Law Firm That “Beat” Apple in The Past

What do you do when a company you have sued hires a law firm which has won a court battle against you before? Well, that is the situation confronting apple at the moment. Apple recently filed a law suit against Psystar earlier this month , whom they accuse of violating Apple’s copyright. Psystar sells Mac clones.

Apple wants systems previously sold by Psystar to be recalled citing Apple's end user license agreement which expressly forbids installation or sales of its operating systems on third-party hardware.

Since then, Psystar has made its first filing in the lawsuit that Apple brought against the small, Florida-based Mac clone maker. According to the filing, Psystar will be represented by Carr & Ferrell LLP, a law firm which has successfully beaten Apple in court in the past.

Alto-based Carr & Ferrell employs more a dozen lawyers specializing in tech industry issues such as copyright and intellectual property law. Court files show that Carr & Ferrell partner Robert Yorio has been assigned to the case, along with staff attorneys Christine Watson and Colby Springer.

According to Insider sources, Psystar believes Apple's prohibition against third-party installations might not hold up in court. Psystar says they will continue to sell the OpenPC system, despite the fact that it appears to violate Apple's Mac OS X EULA.

Psystar Corporation is a Florida-based electronics company, which sells surveillance, communication, and most popularly "Open Computers" made popular by the option to pre-install them with Mac OS X Leopard and making them the first commercially distributed Hackintoshes.
